Current California Heat Illness Prevention Requirements

California currently enforces heat illness prevention regulations under Title 8 of the California Code of Regulations.

These rules require employers to implement protective measures when workers are exposed to high heat conditions.

California Outdoor Heat Rule

Title 8 §3395

The outdoor heat illness prevention rule applies to outdoor worksites where employees are exposed to environmental heat, including industries such as construction, agriculture, landscaping, and utilities.

When Temperatures Reach 80°F

Employers must implement heat illness prevention procedures.

These include:

  • Access to fresh drinking water (at least one quart per worker per hour)
  • Shade available when employees request it
  • Worker training on heat illness prevention
  • Emergency response procedures

These requirements ensure workers can hydrate, cool down, and recognize symptoms of heat illness.

High Heat Procedures at 95°F

When temperatures reach 95°F or higher, additional protections are required.

These include:

  • Pre-shift meetings discussing heat risk
  • Observation of workers for heat illness symptoms
  • Effective communication systems for reporting illness
  • More frequent rest opportunities

These procedures are intended to prevent serious heat illness before it occurs.

California Indoor Heat Rule

Title 8 §3396

California recently expanded heat protections to indoor environments. The Indoor Heat Illness Prevention Standard (Title 8 §3396) applies to indoor workplaces where workers may be exposed to elevated temperatures.

Indoor Heat Requirements

Indoor heat protections begin when workplace temperatures reach 82°F.

  • Access to cool drinking water

High Heat Conditions Indoors

When indoor temperatures reach 87°F or higher, or when workers wear clothing that restricts heat removal, employers must implement additional protections.

  • Mandatory cool-down breaks
  • Environmental monitoring
  • Work schedule adjustments
  • Additional engineering controls
